A Chapter 7 Bankruptcy, also called a "liquidation" bankruptcy, is a form of a personal bankruptcy where the goal is for the debtor to obtain a “fresh financial start” through the discharge of many, if not all, of their outstanding debts.
In a Chapter 7 Bankruptcy, the debtor completes a petition wherein the debtor discloses their income, assets, and debts to the court. A trustee will be appointed by the court to liquidate (sell) a debtor’s assets, which do not fall under the bankruptcy exemption guidelines, and distribute the net proceeds of the sale of non-exempt assets to your creditors. However, in many cases, most, if not all of a debtor’s assets are protected by state or federal exemptions, and may not be subject to the liquidation process. In other words, many debtors will not lose any of their personal possessions due to filing for bankruptcy.
In most situations, many types of debts can be discharged through bankruptcy, including, but not limited to, (1) credit cards, (2) medical bills, (3) utilities, (4) car loans, (5) home loans, and (6) other services.
However, there are many types of debts that cannot be discharged in a Chapter 7 bankruptcy which may include, but not limited to:
Depending on your circumstances, you may be able to keep specific secured property such as your car, furniture, or home; as long as the property is exempt and/or you continue to pay these debts.
Once you have filed for chapter 7 bankruptcy, any pending lawsuits against you by creditors will be halted immediately. This also stops the harassing and threatening phone calls which creditors and collection agencies often rain down upon you. After you have filed for a bankruptcy, creditors and collection agencies can no longer attempt to contact you.
