A Chapter 7 Bankruptcy, also called a "liquidation" bankruptcy, is a form of a personal bankruptcy where the goal is for the debtor to obtain a “fresh financial start” through the discharge of many, if not all, of their outstanding debts.

In a Chapter 7 Bankruptcy, the debtor completes a petition wherein the debtor discloses their income, assets, and debts to the court. A trustee will be appointed by the court to liquidate (sell) a debtor’s assets, which do not fall under the bankruptcy exemption guidelines, and distribute the net proceeds of the sale of non-exempt assets to your creditors. However, in many cases, most, if not all of a debtor’s assets are protected by state or federal exemptions, and may not be subject to the liquidation process.
