A Chapter 7 Bankruptcy, also called a "liquidation" bankruptcy, is a form of a personal bankruptcy where the goal is for the debtor to obtain a “fresh financial start” through the discharge of many, if not all, of their outstanding debts.
In a Chapter 7 Bankruptcy, the debtor completes a petition wherein the debtor discloses their income, assets, and debts to the court. A trustee will be appointed by the court to liquidate (sell) a debtor’s assets, which do not fall under the bankruptcy exemption guidelines, and distribute the net proceeds of the sale of non-exempt assets to your creditors. However, in many cases, most, if not all of a debtor’s assets are protected by state or federal exemptions, and may not be subject to the liquidation process. In other words, many debtors will not lose any of their personal possessions due to filing for bankruptcy.
